Karl Binding came from a family of brewers from Frankfurt am Main. His father George Christoph Binding (1807-1877) was a judge and a professor in Basel. Karl studied law and history in Göttingen. He was habilitated in Heidelberg in 1864 and became a full professor of public law in Basel in 1866. In the same year he married and in 1867 his son, the writer Rudolph G. Binding, was born. In 1870 Karl Binding became professor of criminal law in Freiburg im Breisgau and from 1872 he held the same chair in Strasbourg. In 1873 he moved to Leipzig where he was professor of criminal law until 1913.

In 1909 he became an honorary citizen of the city of Leipzig. In 2010 this was revoked because he had written "Die Genehmigung der Vernichtung lebensunwertes Lebens" together with Alfred Hoche (1865-1943). This work was used by the nazis for their euthanasia campaigns. He died in 1920 in Freiburg im Breisgau.
